Complaints/returning goods

You finally received your package with a surprise for your little one—you open it and it's not what you expected. There could be many reasons for this, but there's no need to be disappointed because

 

OUR COMPANY WANTS ONLY SATISFIED CUSTOMERS, SO YOU HAVE 14 DAYS TO RETURN THE GOODS OR 30 DAYS TO EXCHANGE THEM

... starting from the calendar day after you get the last item from your order. 
 

Send us your withdrawal from the purchase agreement in writing to the email: info@toysimply.eu and it has to be delivered no later than the last day of the 14-day period. Simply send the goods back immediately. If you are sending the goods yourself, please send them as a parcel without cash on delivery to toySimply s.r.o., Pomezí 300, 569 71 Pomezí.

The sooner you send it, the sooner you will receive your refund, no later than 14 days after delivery.

If you are unable to return the goods, you can still exchange them free of charge within 30 days of delivery.

YOU CAN UNPACK THE GOODS

You can unpack and even ‘use’ the goods and still return them. Exceptions include hygienically packaged goods, audio and video media, etc. (detailed below). You probably wouldn't like to receive these goods ‘used’ ;)

1. You can return the goods even if they are ‘used’, but please return them in their original condition to avoid a reasonable reduction in the refund amount to cover the costs of restoring them to their original condition. In short, send it to us as you would be willing to buy it yourself without any objections. You would certainly not like it if the goods arrived in a torn box, dirty, without instructions, or showing other signs of use or damage.

 

2. The goods do not have to be returned in their original packaging, but we would prefer if you sent them in their original packaging, including the filling. Although the packaging is not part of the purchase, we are entitled to reimbursement of the actual costs incurred in restoring the item to its original condition so that it can be sold again.The costs of restoring the goods to their original condition are assessed individually and, as such, may be charged to you and offset against the amount for the returned goods.

Please note that in both cases we are entitled to reimbursement of the costs associated with restoring the goods to their original condition. These costs may theoretically amount to the full price of the goods. The more complete the goods you return, the less damage you cause us and the greater the ‘chance’ that you will receive the full purchase price back. Please remember that we need to resell the goods.

 

 

You are responsible for the costs of returning the goods; you will receive the following payments from us ...
 

  • We will refund the money within 10 calendar days of receiving the returned goods, but we will try to do so as soon as possible :)
  • You will therefore be refunded the price of the goods and the shipping costs, if you paid them. If you received free shipping from us, you are not entitled to a refund of the shipping costs.
  • The shipping costs (costs of delivery of the goods) will be refunded according to the cheapest method of delivery offered by us (even if you chose a method other than the cheapest one).
  • The payment method fee (e.g. cash on delivery) is not refundable, as it was your choice of payment with an additional charge. We also offer payment methods without additional charges.
  • Where and how to send

 

Please pack the goods so that they are not damaged during transport, i.e. preferably in a box with adequate padding, ideally in the packaging in which we sent them to you. If you are packing the goods in an envelope or plastic film, please consider whether this packaging is appropriate for the nature of the goods and their original packaging. Insure the package for its value, enclose the form below and a copy of the receipt (you will find this as an attachment in our email confirming dispatch of the shipment). If you do not wish to use the form, please send us a copy of the document with your withdrawal from the contract or request for exchange written on the back, listing the goods concerned, the account number to which we should return the amount, or the goods for which we should exchange them, and sign it.

If you are sending the goods yourself, please send them as a parcel without cash on delivery to toySimply s.r.o., Pomezí 300, 569 71 Pomezí.

However, if you fill in the form and send it to info@toysimply.eu with a request for collection, we will take care of everything and you will only need to ensure that the goods are adequately packaged as described above.

What goods cannot be returned at all?

Among other things, goods that have been modified according to the wishes of the consumer or for their person, from the purchase contract for the delivery of goods that are subject to rapid deterioration, as well as goods that have been irrevocably mixed with other goods after delivery, from a purchase contract for the delivery of goods in sealed packaging which the consumer has removed from the packaging and which cannot be returned for hygiene reasons, and from a purchase contract for the delivery of audio or video recordings or computer programs if their original packaging has been broken. By law, the consumer may not withdraw from a contract in particular:

  • the provision of services, if they were performed with the consumer's prior express consent before the expiry of the withdrawal period and the trader informed the consumer before the conclusion of the contract that he would not have the right to withdraw from the contract
  • the supply of goods or services whose price depends on fluctuations in the financial market independent of the entrepreneur's will and which may occur during the withdrawal period
  • the supply of alcoholic beverages which can only be delivered after thirty days and whose price depends on fluctuations in the financial market independent of the entrepreneur's will
  • delivery of goods which have been customised according to the consumer's specifications or for his personal use
  • delivery of goods which are liable to deteriorate rapidly, as well as goods which, after delivery, have been irretrievably mixed with other goods
  • repairs or maintenance carried out at the place specified by the consumer at his request; this does not apply, however, in the case of subsequent repairs other than those requested or the delivery of replacement parts other than those requested
  • delivery of goods in sealed packaging which the consumer has removed from the packaging and which cannot be returned for hygiene reasons
  • delivery of audio or video recordings or computer programs, if the consumer has broken the original packaging
  • delivery of newspapers, periodicals or magazines
  • accommodation, transport, catering or leisure activities, if the trader provides these services on a specified date
  • concluded on the basis of a public auction in accordance with the law governing public auctions, or
  • delivery of digital content, unless it was delivered on a tangible medium and was delivered with the consumer's prior express consent before the expiry of the withdrawal period and the trader informed the consumer before the conclusion of the contract that they would not have the right of withdrawal in such a case.

Exceptions are cases where withdrawal from the contract is expressly agreed
