I. Basic Provisions

  1. The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) is toySimply s.r.o., Company ID 08053642, with registered office at Sulkovec 76, 59265 Rovečné (hereinafter referred to as the “controller”).

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
  4. The controller has not appointed a data protection officer.

 

 

II. Legal Basis for Processing Personal Data

  1. The legal basis for processing personal data is:  
  • Performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR (hereinafter “Performance of Contract”),
  • The legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR (hereinafter “Legitimate Interest”),
  • Your consent to processing for the purpose of providing direct marketing (especially for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with § 7(2) of Act No. 480/2004 Coll., on certain information society services, if no goods or services have been ordered (hereinafter “Consent1”).

         2. The controller does not carry out automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.

         3. ToySimply hereby informs its customers that it is interested in continuously improving its services and increasing customer satisfaction. In connection with fulfilling the above objective, we process the personal data you have provided to us                    (name, surname, email address, telephone number, transaction date, order ID, and information about purchased products). The reason for processing personal data is the legitimate interest in increasing customer satisfaction and the quality of                  our services.

         4. For this purpose, after purchasing our products, we will send a satisfaction survey to your address. For the evaluation of satisfaction surveys, we cooperate with our partners, the operator of the web portal spolehliverecenze.cz and the                              company eKomi Holding GmbH, to whom we provide the above personal data for this purpose.

         5. If you do not agree with receiving the satisfaction survey and the transfer of your personal data to the above-mentioned companies, you have the right to object to such processing, either by email at info@toysimply.eu or by following the                       procedure set out in the satisfaction survey. or by following the procedure set out in the satisfaction survey.

IV. Data Retention Period

            1. Unless stated otherwise above, the controller retains personal data:

  • For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years after the end of the contractual relationship).
  • Until consent to the processing of personal data for marketing purposes is withdrawn, if the data is processed based on consent.

             2. After the retention period, the controller will delete the personal data.

 

 

V. Recipients of Personal Data (Controller’s Subcontractors)

          1. Recipients of personal data are persons based on a contractual relationship:

  • Involved in the delivery of goods and payment processing under the contract (carriers, pick-up points, etc.),
  • Providing services related to the operation and maintenance of the e-shop,
  • Providing marketing services,
  • Providing accounting services.

          2. The controller may transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries are exclusively providers of mailing services, data and file storage, and analytical             tools.

 

VI. Your Rights

               1. Under the conditions set out in the GDPR, you have:

  • The right of access to your personal data under Article 15 GDPR,
  • The right to rectification of personal data under Article 16 GDPR, or restriction of processing under Article 18 GDPR,
  • The right to erasure of personal data under Article 17 GDPR,
  • The right to object to processing under Article 21 GDPR,
  • The right to data portability under Article 20 GDPR,
  • The right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms.

               2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

 

 

VII. Conditions of Personal Data Security

  1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
  2. The controller has taken technical measures to secure data storage and personal data storage in paper form (passwords, encryption, antivirus programs, lockable premises, etc.).
  3. The controller declares that only persons authorized by the controller have access to personal data.

 

VIII. Final Provisions

  1. By submitting an order via the online order form, you confirm that you are familiar with the terms of personal data protection and that you accept them in their entirety.
